Last Will and Testament
Harold Edwin Drewry (d 1985)
Botetourt County, Va.

I, Harold Edwin Drewry, of Botetourt County, Virginia, being of sound and disposing mind, do hereby make, publish and declare this to be my last will and testament, hereby revoking all wills and codicils at any time heretofore by me made.
First, I direct my executor, as hereinafter named, to pay all my just debts and funeral expenses, from my personal or mixed estate or, in his or her discretion, from my real estate, any provision of law to the contrary notwithstanding; and in his or her discretion to compromise or arbitrate any and all claims or demands which may be presented against my estate, and his or her discretion shall not be subject to review. My grave is to be located in the lot I have purchased in the Blue Ridge Memorial Gardens.
Second, I hereby give, devise and bequeath all my estate, real, personal, and mixed, to my wife, Margaret Elaine Lowe Drewry, but if Margaret Elaine Lowe Drewry has predeceased me, or in the event that Margaret Elaine Lowe Drewry and I have died under such circumstances that there is not sufficient evidence to determine which predeceased the other, I hereby give, devise and bequeath all my estate, real, personal and mixed, to my daughter, Stephanie Elaine Drewry.
Third, all estate, inheritance, transfer, legacy, succession, and other death taxes of any nature which may be payable by reason of my death, and/or which may be assessed or imposed upon or with respect to the legacies or devises provided in this will, shall be paid out of my estate as an expense of administration and in such a manner and at such times as directed by law and by the executor hereinafter appointed in his or her discretion.
Fourth, I hereby nominate, constitute and appoint as my executor of this my last will and testament my wife, Margaret Elaine Lowe Drewry, or if she is incapable or unwilling to serve as executor, then my brother-in-law, W.C. Kirkman, of 100 Pine Road, Cheasapeake, Virginia is hereby so nominated, constituted, and appointed. I hereby direct that neither Margaret Elaine Lowe Drewry nor W.C. Kirkman (nor Stephanie Elaine Drewry should she qualify as executrix by reason of inability or unwillingness of either of the above-named to serve) be required to furnish bond for the performance of their duties as executor, any provision of law to the contrary notwithstanding. My executor shall receive for his or her services such compensation as is fair, reasonable and just.
In Witness Whereof I have hereunto set my hand and seal this 10 day of August, 1973, to this, my last will and testament, written without any interlineation.
